The Russian Constitutional Court (KS) has ruled that the right of government organs to confiscate private property without going through the courts is unconstitutional. The ruling, valid from 11 March, directly forbids confiscation in two cases: goods and means of transport (for excessive storage time in customs warehouses) and weapons used for illegal hunting. The ruling states that a court decision is required in all cases when there is a question of the confiscation of property.
St Petersburg Customs Press Attache Valery Anikin commented on the court's ruling, "The GTK [State Customs Committee] suspended the examination of cases where the customs rules in TK section 266 are violated. But the effective abolition of the section leaves a blank space in customs legislation. There are large volumes of cargo in customs storage, and there are cases when the cost of storage is greater than the value of the cargo itself who will compensate that loss?"
